ClubShare Rental Agreement
This agreement provides important information for understanding the rental process as well as your liability as a renter.
All Renters using ClubShare's services must acknowledge and agree to the following:
**ACTION REQUIRED** By clicking "accept", this acts as a signature in a legally binding agreement. The Rental Agreement is also part of ClubShare's Terms of Service. By creating an account and using the site, you agree to all conditions of the Terms of Service, Rental Agreement and Privacy Policy.
**ACTION REQUIRED** Following the rental exchange (drop-off), you (the renter) must go to your ClubShare Dashboard and select the option "I received the club rental and returned them in the same condition I received them in". This is very important for both parties and releases your liability, when verified. You will also receive an email to the email linked to your account reminding you of this step. You only have 24 hours from the end of the rental period to complete this step or report any damages, lost items or incidents or not receiving clubs returned, for a refund, to support@clubshare.com to begin the process of filing an Incident Report. See below.
You, the renter is contractually obligated to cover any loss, damage, misuse or theft of the rental listing in all cases where they are deemed responsible. Excluding coverage instances, (please refer throughout this agreement). If any incident or damage occurs, you must report it to ClubShare via the Review Form (appears immediately after listing rental period), within 24 hours. You may also reach out to us via support@clubshare.com. This process MUST be done within 24 hours of the end of the rental period for each transaction!

You (the renter) agree to pay a Coverage Fee per transaction (not per day), additional to the cost of the rental. The fee is $4.50 and includes $250 worth of coverage, with a deductible. The deductible is $25 for the amount of coverage qualified for. This does not adjust based on how much coverage is used if an incidence occurs. the deductible stays flat based on the amount of coverage offered.
You (the renter) are fully responsible for effective communication with the lister regarding your availability and schedule. This includes the pick-up and drop-off of the club(s). The purpose of entering your tee time and preferred pick-up/drop-off location is to give the lister an idea of when and where they need to meet up with you for the exchange. This can include, but is not limited to - early in the morning, the night before or right before your tee time. If you (the renter) have an early tee time and you and the lister both agree that the night before the rental period starts is the best for both of you to do an exchange, you will not be charged for that night (rental day), not part of the rental period. The lister's clubs are still covered for damage/theft if that be the case.
Communication and exchanges not displayed or taking place through ClubShare's chat feature could result in permanent banishment of the user from the site and will not be covered by or apply to any of ClubShare's Terms of Service. ClubShare is not responsible for any communication outside of ClubShare.com. This can include but is not limited to - participating in a transaction outside the site and setting up an exchange outside of the purpose and functionality of the site. This can include texting and email or phone calls between the renter and lister.
Both you (the renter) and the lister should be conscious and understanding of convenience factors for both parties. This could include, but not limited to - being on vacation and travel arrangements for the renter and work schedule or disabled days for the lister.
As you likely noticed from the functionality of the rental days calendar (displayed on the club listing), you (the renter) is only allowed to rent clubs on single or consecutive days, with no restricted/disabled days falling within the rental period. This is for the protection and convenience of the lister. If you (the renter) need to rent the same clubs (listing) on multiple, non-consecutive days, please email support@clubshare.com for possible exceptions or accommodation.
You (the renter) are fully responsible for the golf clubs and all related items, such as, but not limited to, golf bag, headcovers, accessories, etc. However, items WITHIN the golf bag are not covered by ClubShare under your Terms of Service. You (the renter) agree to being charged for fair replacement value of all lost or damaged items not covered under "ClubShare Coverage".
Do not leave the rented clubs unsupervised or attempt a drop-off at or with anyone except the lister, at the agreed upon location. The golf course, driving range or pro shop is not responsible or involved in the transaction in any whatsoever.
You (the renter), has sole responsibility and liability for the rental from the moment of the exchange (pick-up/drop-off), to the moment of the lister retrieving the clubs from you after your round.
You agree to the commitment and understanding of treating the clubs as you would treat your own. This includes returning the clubs clean or in/near the condition cleanliness of which you received them.
Please note the general condition of the clubs as referenced in the listing. Make sure they are in good operating condition, free of structural and performance damage - including but not limited to, cracks, broken or bent shafts or heads, large or medium sized defects or damages, overly worn grips, etc. The lister is responsible for noting any defects, imperfections or damage as fact (truth) in their listing.
If personal items of the lister are contained in the bag during the rental period, please note when receiving the rental and let the lister know. the lister is responsible for making sure these items are not in the bag during the rental. However, a lister may choose to offer the renter ball, tees, glove, etc. as an included item.
Do not under any circumstances, hit the rental clubs on or out of any surface not in bounds or part of the playable golf hole. This includes but is not limited to - cement, drainage, sprinklers, gravel, desert landscape, roots, trees, bushes, or hard, compact surfaces including unkempt bunkers. You (the renter) shall not alter the clubs in any way, this includes but is not limited to any numbering, lettering, tags, barcode, stickers or insignia displayed on or within the equipment, and shall see that the equipment is not subjected to careless, unusually or needlessly rough usage.
If you do not return the clubs on the last day of your rental period, unless communicated by the lister due to their unavailability, you could be charged for an additional rental day or more.
If you (the renter) leave a club behind, you must retrieve it and return it to the lister by the end of the rental period.
If you (the renter), steal, get stolen from, misplace, damage or misuse the rented item, you could be held responsible and liable for the value of the item, if deemed responsible. Although an agreement will be sought, ClubShare has the sole discretion as to the repair or replacement value/cost that could be charged to your credit card. ClubShare reserves the right to authorize your credit card up to the predetermined estimated value of the rented items to protect the respective parties and their equipment. This is an authorization, not a charge. This can occur at any time during, prior to or following the rental period. Please see below.
If you break any of the following rules above, it may result in immediate banishment from the site.
It is required that the lister checks their clubs upon receiving them from you (the renter) at the end of the rental period. This includes noting any damage, and also making sure no clubs are missing. The lister may ask you (the renter) if a club is missing.The lister may submit an Incident Reporting Form if there is an issue with their gear or the transaction. You, the renter also have the ability and responsibility to note and document any damage upon receiving the clubs that may or may not have been properly stated in the club rental listing. Please document prior to use and reach out to ClubShare immediately if you feel something was misrepresented in the listing. This can and may protect you in certain instances of damage.
If the lister receives the clubs back from the rental transaction and you (the renter) claim you returned all the clubs via the Review Form yet the lister finds or claims a or more than 1 club is missing, an investigation will ensue. If ClubShare cannot determine who is responsible for the missing equipment, you might be deemed financially responsible ClubShare. This is possible due to the investigation process by ClubShare. If it becomes the word of the renter vs the word of the lister, ClubShare will try to satisfy both parties to the best of their ability. There is no guarantee of payment or release of liability given this unique and strongly discouraged situation.
If you (the renter) have damaged a club during the rental, email support@clubshare.com for an Incident Report Form. ClubShare Renter Damage Coverage will cover incidents for the value mentioned in above sections. You (the renter) can choose to either use ClubShare Renter Damage Coverage with the deductible, or pay for the damage from your credit card used for the transaction. ClubShare reserves the right to make this determination on your behalf if an answer is not received in a timely manner. The rental coverage provided by ClubShare ONLY covers damage by normal, intended use of the club(s). It does NOT cover theft, loss or misuse, damage caused by improper use or any other action defined in this contract or our Terms of Service. If the rental club(s) are broken, damaged, misused in any way, you will be held responsible for the damages. The valuation of damages is determined by "like" condition, quality or clubs for reimbursement, repair or replacement. This value is determined by ClubShare using a range of factors - those of which can be changed or modified at any time, pursuant to the Terms of Service. If rental clubs are lost or stolen, you, the renter will be responsible for the full value minus depreciation (current value) of the set. This will be charged to your credit card used for the transaction. ClubShare reserves the right to determine if the club was damaged by normal use or if it was misused, resulting in voided coverage.
If you (the renter) choose to cancel the rental request 24 or fewer hours before your "tee time" start time (the first time in your range selected) you will be charged for the full amount of the day for the rental.
This agreement is both binding and included as part of the Terms of Service of Clubshare LLC. By agreeing to this, you are also agreeing to the Terms of Service and Privacy Policy of ClubShare LLC.
